୧୨ ବର୍ଷ ହେଲା ପଦୋନ୍ନତି ନାହିଁ, ୯ ବର୍ଷ ହେଲା ମିଳିନି ଆରଏସିପି ବର୍ଦ୍ଧିତ ଅର୍ଥ

ଭୁବନେଶ୍ୱର:୧୪/୬–ନ୍ୟାୟକୁ ଅପେକ୍ଷା କରି ଇତିମଧ୍ୟରେ ଅନେକ କର୍ମଚାରୀଙ୍କର ପରଲୋକ ଘଟିଲାଣି। ସଂଖ୍ୟାଧିକ ଅବସର ନେଲେଣି। କିନ୍ତୁ ସରକାରୀ ବ୍ୟବସ୍ଥାରେ ନ୍ୟାୟ ବିଳମ୍ବିତ ହେବାରେ ଲାଗିଛି। ପ୍ରଶାସନିକ ଅଧିକାରୀଙ୍କ ଅବହେଳା ଏବଂ ଦାୟିତ୍ୱହୀନତା ପାଇଁ ମୃତ କର୍ମଚାରୀଙ୍କ ପରିବାର ଏବଂ ଅବସରପ୍ରାପ୍ତ କର୍ମଚାରୀମାନେ ନ୍ୟାୟ ପାଉ ନ ଥିବାରୁ ଅତ୍ୟନ୍ତ ଦୁର୍ଦଶା ଭିତରେ ଗତି କରୁଛନ୍ତି । ସେମାନଙ୍କୁ ଉପଯୁକ୍ତ ପରିମାଣର ପରିବାର ପେନସନ ଓ ପେନସନ ମିଳିପାରୁ ନାହିଁ। 12ବର୍ଷ ତଳୁ ଏହି କର୍ମଚାରୀଙ୍କୁ ଧାର୍ଯ୍ୟ ସମୟରେ ମିଳିଲାନି ପଦୋନ୍ନତି, ଠିକ ସମୟରେ ଦିଆଗଲାନି ଦ୍ଵିତୀୟ ଆରଏସିପି ଫଳରେ ସଂପୃକ୍ତ କର୍ମଚାରୀମାନେ ଆର୍ଥିକ କ୍ଷତିଗ୍ରସ୍ତ ହେଲେ । 2016ରୁ ଆରଏସିପି ଦିଆନଯିବାରୁ ସେମାନେ ଗ୍ରେଡ ପେ 4200 ବଦଳରେ ପାଇଲେ 2800 । ଅବସରପ୍ରାପ୍ତ ଓ କାର୍ଯ୍ୟରତ କର୍ମଚାରୀମାନେ ସରକାରଙ୍କୁ କ୍ରମାଗତ ଭାବେ ଆପତ୍ତି କରୁଥିଲେ ମଧ୍ୟ ଏପର୍ଯ୍ୟନ୍ତ ମିଳିପାରୁନି ନ୍ୟାୟ।

ଏହି କର୍ମଚାରୀମାନେ ଓଡିଶା ଜିଲା କ୍ୟାଡର ନିଯୁକ୍ତି ଓ ସେବା ସର୍ତ୍ତ ନିୟମାବଳୀ, 1963, ଅନୁଯାୟୀ ଆରଏସିପିର ୨ୟ ପର୍ଯ୍ୟାୟରେ 4200/- ଗ୍ରେଡ ପେ ପ୍ରଦାନ ପାଇଁ ସରକାରଙ୍କୁ ଆପତ୍ତି କରି ନିରାଶ ହେଲେଣି।

Respected sir,,

ମୁଁ, ଶ୍ରୀ ସଞ୍ଜୟ କୁମାର ମହାପାତ୍ର, ଅବସରପ୍ରାପ୍ତ ବରିଷ୍ଠ କିରାଣି, ଜିଲ୍ଲା ଉପଭୋକ୍ତା ବିବାଦ ନିରାକରଣ ଆୟୋଗ, ଭୁବନେଶ୍ୱର ଆପଣଙ୍କ ଦୃଷ୍ଟି ଆକର୍ଷଣ ଏହି ଅନୁରୋଧ ପତ୍ର ପ୍ରଦାନ କରୁଛି।

ଖାଦ୍ୟ ଯୋଗାଣ ଓ ଉପଭୋକ୍ତା ସୁରକ୍ଷା ବିଭାଗର ନିୟନ୍ତ୍ରଣ ଅଧୀନରେ ଚାରିଟି ଶାଖା କାର୍ଯ୍ୟରତ ଅଛି:

1. Civil Supplies Wing
2. Legal Metrology Wing
3. Market Intelligence Wing
4. District Consumer Disputes Redressal Commissions

ଏହି ସମସ୍ତ ଶାଖାପାଇଁ Junior Clerk, Senior Clerk ଓ Head Clerk ପଦସମୂହ ସୃଷ୍ଟି ହୋଇଥିଲା ଓ ତାହା ଓଡ଼ିଶା ଜିଲ୍ଲା କ୍ୟାଡର ନିୟମାବଳୀ, 1963 ଅନୁଯାୟୀ ଶାସିତ ହୋଇଥିଲା।
ଏହି ନିୟମ ଅନୁଯାୟୀ, Junior Clerk ରୁ Senior Clerk ଓ Senior Clerk ରୁ Head Clerk ପଦକୁ ଦୁଇଟି ବୃନ୍ଦତମନ୍ୟ ଉନ୍ନତି ଉପଲବ୍ଧ ହେବା ଥିଲା। କିନ୍ତୁ ଏହି ଶାଖାମାନଙ୍କ ମଧ୍ୟରୁ 11.11.1993 ରେ ଏକ ବିଭାଗୀୟ ପ୍ରସ୍ତାବ ଅନୁଯାୟୀ Civil Supplies ଅଲଗା କରାଯାଇ ଏହି ଶାଖାଗୁଡ଼ିକୁ Composite Cadre ରେ ଅନ୍ତର୍ଭୁକ୍ତ କରାଯାଇଥିଲା।

ଏହି ପ୍ରସ୍ତାବ ଏକ ସ୍ଥାୟୀ ବିଭାଗୀୟ ନିର୍ଦ୍ଦେଶ ହେବା ସତ୍ତ୍ୱେ ଏହା ଏକ ନିୟମ ନୁହେଁ ଓ ଏହା 1963 ର ନିୟମକୁ ବାତିଲ କରିପାରିବ ନାହିଁ। ଏହି ଭୁଲ ପ୍ରସ୍ତାବ ଦ୍ୱାରା Civil Supplies ଶାଖା ଓ ଅନ୍ୟ 3ଟି ଶାଖାରେ ବିଷମତା ସୃଷ୍ଟି ହୋଇଛି। ଯେଉଁଥିରେ ଅନ୍ୟମାନେ Head Clerk ପଦ ମାନ୍ୟତା ଉପଲବ୍ଧ କରିପାରିଛନ୍ତି, ମୁଁ ଏହାରୁ ବଞ୍ଚିତ ହୋଇଛି। ତଥାପି ମୋତେ ଦ୍ୱିତୀୟ ଆର.ଏ.ସି.ପି. ଅନ୍ତର୍ଗତ Rs.4200/- ଗ୍ରେଡ୍ ପେ ଦିଆଯାଇ ନାହିଁ, ବରଂ ₹2800/- ଦିଆଯାଇଛି।

ଅନେକ କର୍ମଚାରୀ ଏହି ଅନ୍ୟାୟ ବିଷୟରେ ସରକାରଙ୍କ ନିକଟରେ ଅଭିଯୋଗ ଦାଖଲ କରିଛନ୍ତି। ବିଭାଗୀୟ କମିଟି ମଧ୍ୟ ବିଷୟଟି ଠିକ୍ ବୁଝି 02.12.2016, 23.07.2017 ଓ 22.05.2018 ର ବୈଠକରେ ନିମ୍ନଲିଖିତ ସୁପାରିଶ ଦେଇଛନ୍ତି:

Sub: Prayer for sanction of Grade Pay ₹4200/- under 2nd RACP as per the

Odisha District Cadre Recruitment Rules, 1963, Finance Department Resolution No. 5073 dated 13.02.2025, and the principle laid down in the Biharilal Barik case.

Respected Sir,
With due respect, I, Sri Sanjaya Kumar Mohapatra, Retired Senior Clerk, District Consumer Disputes Redressal Commission, Bhubaneswar, most humbly submit this application seeking your kind intervention for redressal of my long-pending grievance relating to non-sanction of 2nd RACP benefits. Under the administrative control of the Food, Supplies & Consumer Welfare Department, four wings are functioning:

1. Civil Supplies Wing
2. Legal Metrology Wing
3. Market Intelligence Wing
4. District Consumer Disputes Redressal Commissions

Posts such as Junior Clerk, Senior Clerk, and Head Clerk were created for these wings under the head of account, and recruitment to these posts was originally governed by the Odisha District Cadre Recruitment and Conditions of Service Rules, 1963. As per the Finance Department guidelines, there should be two promotion avenues: from Junior Clerk to Senior Clerk and Senior Clerk to Head Clerk.
However, in 1993, the Department introduced a Resolution (dated 11.11.1993), rationalizing the cadre structure for the ministerial staff of Legal Metrology, Market Intelligence, and Consumer Disputes Redressal Forums—excluding the Civil Supplies Wing.
This resolution integrated the above three wings into a composite cadre, with vacancies in the Junior Clerk post to be filled through rotation by candidates recruited via Collectorates under OMS Rules, 1985.
It is respectfully submitted that this Resolution is merely a departmental standing instruction and does not override or supersede the Odisha District Cadre Recruitment Rules, 1963, which is a statutory rule governing our service conditions. The Resolution dated 11.11.1993 inadvertently created disparities between the Civil Supplies Wing and the other three wings. Despite all these posts being created under the same department and governed initially by the same rules, the Civil Supplies Wing employees have been deprived of promotion due to the non-posting of vacancies for Junior Clerk, Senior Clerk, and Head Clerk by the Food Supplies and Consumer Welfare Department. Instead, the Revenue Department adjusted these vacancies by promoting its own cadre employees. Consequently, many employees, including myself, have not been denied promotion to the post of Head Clerk and also denied financial upgradation under the 2nd RACP. While others under the Civil Supplies Wing were allowed Grade Pay of Rs.4200/-, I was only granted Rs.2800/- under the 2nd RACP, creating a gross disparity. Several grievance petitions are pending in this regard.

Despite having served for over 20 years, I have not been granted the benefits of 2nd RACP with Grade Pay Rs.4200/- as admissible under ORSP Rules, 2008 and FD Resolution dated 06.02.2013. I was also not considered for promotion to the post of Head Clerk, though the post exists in the Civil Supplies Wing, and the same is treated as a promotional post for other similarly placed employees.

The departmental committee constituted to examine this issue, in its proceedings dated 02.12.2016, 23.07.2017, and 22.05.2018, admitted the anomaly and recommended:
 Dissolution of the composite cadre
 Constitution of a separate District Cadre for ministerial staff of all four wings
 Grant of Grade Pay Rs.4200/- to eligible employees like me under the 2nd RACP

Yet, no final action has been taken, and my grievance remains unresolved. Employees who joined service with me are either working as Head Clerks or are drawing Grade Pay Rs.4200/-, It is pertinent to mention that my Drawing and Disbursing Officer is the CSO. My service book, financial bills, budget, and other official matters are processed through the CSO, clearly indicating that I function as an employee of the Civil Supplies Wing. Therefore, the Head Clerk post under the Civil Supplies Wing should rightly be considered a promotional post for employees like me from the composite cadre.
 As per the Biharilal Barik case judgment [W.P.(C) No. 2831 of 2016]
 Finance Department Letter No. 19420 dated 01.07.2020 regarding extension of RACP benefits as per Court orders In light of the above and in the interest of natural justice.

I most humbly request your kind self to:
1. Direct the concerned department to sanction Grade Pay Rs.4200/- under 2nd RACP to me as per the Odisha District Cadre Rules, 1963 and the principle laid
down in the Biharilal Barik case.
2. Refer this matter to the Finance Department for examination as per FD Letter No. 19420 dated 01.07.2020.

Your kind intervention will help correct a long-standing injustice and bring relief to a sincere and retired public servant.
